The following privacy notice addendum, supplements the information contained in the Newfold Digital, Inc. Privacy Notice (the “Privacy Notice”), is applicable to you when you use the website and any applications, services, products and/or tools (collectively the “Services”) provided by Ecomdash (“we,” “us,” or “Ecomdash”).
Ecomdash provides technology and services that enable companies (each, an “Ecomdash Client”) to use online marketplaces to acquire customers and maximize inventory yield.
The privacy notice, including this addendum, applies regardless of how you access or use these Services, including access via mobile devices and applications. Please review the below in addition to the Privacy Notice.
INFORMATION WE COLLECT FROM BUYERS
We collect personal information from buyers who transact with an Ecomdash Client ( “Buyer”), including when a Buyer purchases a product or service from an Ecomdash Client or participates in an Ecomdash Client’s auction.
Ecomdash may also collect information about a Buyer’s bidding, buying and selling history as well as third party comments regarding a Buyer’s bidding, buying and selling behavior. Bidding and buying history may specifically include a Buyer’s history with respect to any failure to complete sales on winning bids. As part of the registration or checkout process, Ecomdash may ask a Buyer to provide contact and billing information and other personal information.
HOW WE USE YOUR INFORMATION
We facilitate the sharing of information as part of the transaction process between Ecomdash Clients and their Buyers. If you are making a sale as an Ecomdash Client or a purchase via the Services as a Buyer, you are directing us to share your information in accordance with this Privacy Notice. More specifically, when a Buyer transacts with an Ecomdash Client (for example, by purchasing an item from an Ecomdash Client), we share personal information about the Buyer with that Ecomdash Client in order to assist Ecomdash Clients with the sale of their products and the Buyers with their purchases. Ecomdash will retain the Buyer’s information to support the transaction. To the extent that Ecomdash Clients have access to a Buyer’s personal information, Ecomdash does not control the use of such personal information by Ecomdash Clients. Ecomdash Clients are contractually obligated to treat the Buyer’s personal information securely. If you are a Buyer, you are encouraged to review the privacy notices of the Ecomdash Clients that provide the products or services related to your bid or purchase to understand how your personal information may be used by such Ecomdash Clients.
Ecomdash may use any information collected related to the bidding, buying or selling history of Ecomdash Clients and their Buyers to generate recommendations and predictions related to the likelihood or willingness of Buyers to complete a bid and Ecomdash may submit such history and recommendations to Ecomdash Clients.
DATA TRANSFER
In order for us to provide the Services to you, your personal information will be transferred to, and stored and processed in, the United States. We will take all steps reasonably necessary to ensure that your personal data is treated securely and in accordance with this notice.
For transfers of personal information outside of the EEA and Switzerland within the Newfold corporate family and for transfers of personal information to third parties, such transfers will be pursuant to the relevant European Commission’s Standard Contractual Clauses for the Transfer of Personal Data to Third Countries (“SCCs”), unless the data transfer is to a country that has been determined by the relevant EEA or Swiss authorities, as applicable, to provide an adequate level of protection for individuals’ rights and freedoms for their personal information.
For transfers of personal information outside the UK by our UK companies within the Newfold corporate family and for transfers of personal information to third parties, such transfer will be pursuant to the relevant European Commission’s Standard Contractual Clauses for the Transfer of Personal Data to Third Countries (“SCCs”), or any equivalent contracts issued by the relevant competent authority of the UK, as relevant, unless the data transfer is to a country that has been determined by the relevant UK authorities to provide an adequate level of protection for individuals’ rights and freedoms for their personal information.

In the event of conflict between the Privacy Shield (see below) and the SCCs in the DPA, the SCCs control.
